Introduction

Welcome to Softair Technology. These Terms and Conditions (the "Terms") govern your use of our website, software solutions, mobile applications, IT services, and any related deliverables (collectively, the "Services"). By engaging with our Services, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, please refrain from using our Services.

Company Overview

Softair Technology is a registered technology firm providing professional solutions in:

  • Custom software and mobile app development
  • Web design and development
  • Cloud and server setup
  • API and system integration
  • IT consultation, automation, and digital transformation

We strive to deliver innovative, secure, and scalable solutions designed to help our clients grow and succeed. However, all projects are subject to the mutual agreement, defined scope, and these Terms.

Acceptance of Terms

By using our Services or signing a project agreement, quotation, or proposal, you confirm that you are legally authorized to represent your organization and that you accept these Terms on its behalf. Continued use of our Services after any updates to these Terms will constitute acceptance of those updates.

Scope of Work

Each project’s scope, features, and timelines are clearly defined in the official quotation or agreement. Any functionality, feature, or service not mentioned in the scope shall be treated as an additional requirement and may incur extra cost and time.

Project Execution, Review & Client Responsibility

Projects are executed in phases or milestones. After completion of each phase, the deliverables will be shared for review and approval.

  • Clients must review, test, and provide feedback within the agreed review period.
  • If no feedback is received within this period, the milestone will be deemed approved by default.
  • Once approved (explicitly or by default), subsequent changes or complaints will be treated as new requests and will be billable separately.

If a client claims post-delivery that the software does not meet expectations despite milestone approvals, Softair Technology shall not be held liable. Such issues will be considered client-side oversight during testing or review.

Design, UI/UX & Revisions

Design drafts and UI layouts are shared for approval before final implementation. Once approved, any further visual or functional changes will be considered change requests and billed separately.

Client Responsibilities

  • Provide complete and accurate project requirements, content, and data in a timely manner.
  • Assign a single point of contact for communication and approvals.
  • Ensure that all shared content is original and free from third-party copyright violations.
  • Promptly respond to Softair Technology’s requests for clarification or testing feedback.
  • Adhere strictly to payment schedules and milestones.

Payment, Refund & Cancellation

All project payments must be made according to the agreed schedule in the quotation or invoice. Work may be paused if payments are delayed.

  • All completed milestone payments are non-refundable.
  • If the client cancels a project midway, all completed work will be billed up to the cancellation date.
  • Project files, source code, or credentials will be delivered only after full and final payment.

Post-Delivery Support & Maintenance

After project delivery, Softair Technology provides a limited support period (as mentioned in the agreement) for bug fixes only. Enhancements, new features, design changes, or server-related issues after this period are treated as new tasks and billed separately.

Confidentiality

Both parties shall maintain confidentiality regarding proprietary data, source code, or business information shared during the engagement. No information shall be disclosed to third parties without written consent, except when legally required.

Intellectual Property

All intellectual property—including designs, source code, and documentation—created by Softair Technology remains its property until full payment is received. Upon completion and full payment, ownership rights may be transferred as per the signed agreement.

Liability & Disclaimer

Softair Technology shall not be responsible for:

  • Client-provided data inaccuracies or incomplete information affecting deliverables.
  • Third-party API or hosting failures.
  • Delays caused by the client’s lack of timely response, testing, or approvals.
  • Loss of data or revenue arising from misuse, modification, or misconfiguration by the client.

Our total liability under any project shall never exceed the total amount paid by the client for that project.

Validity of Agreements and Documents

All quotations, proposals, invoices, and agreements are considered valid only when signed by both official partners of Softair Technology and stamped with the company seal.

Any document (physical or digital) lacking both signatures and the company stamp shall be deemed unauthorized and invalid.

Client Satisfaction Policy

We are committed to delivering high-quality services and maintaining transparent communication. However, client satisfaction is also dependent on mutual cooperation, timely communication, and approval during project milestones. Any dissatisfaction raised after delivery, without prior feedback during development, will not qualify for rework or refund.

Force Majeure

Softair Technology shall not be held liable for delays or failures caused by events beyond its reasonable control, including natural disasters, technical outages, government actions, or network failures.

Governing Law & Dispute Resolution

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
